1. Service Description
HD Swiftwave Shipping provides courier and logistics services within Jamaica, including:
Air Freight: Transportation of goods via air carriers for expedited delivery.
Sea Freight: Transportation of goods via maritime carriers for bulk or non-urgent shipments.
Ground Transportation: Inland movement of goods by road within Jamaica.
Additional services include placing orders on behalf of customers using the company card and at-home delivery services, which are subject to additional fees.
2. Customer Responsibilities
Customers agree to:
Ensure all shipments are properly packaged, labeled, and secured to withstand normal handling and transit.
Provide accurate and complete documentation, including invoices, declarations, and identification where required.
Declare the true value and contents of all shipments.
Ensure items submitted for shipping comply with Jamaican laws, customs regulations, and the Company’s prohibited items list.
Pay all applicable charges, duties, taxes, and fees in a timely manner.
The Company reserves the right to refuse, delay, or return shipments that do not meet these requirements.
3. Company Responsibilities
The Company undertakes to:
Exercise reasonable care in handling and transporting shipments.
Deliver shipments within the standard delivery timeframes, subject to service type, customs clearance, weather conditions, and other external factors.
Communicate delays or issues where reasonably possible.
The Company does not control the frequency of shipments as the standard shipments per week are on Mon, Wed and Fri, packages will be ready for pickup by Tue, Thu and Sat of each week. Shipment delays will be communicated to each customer in a timely manner.
4. Pricing and Payment
4.1 Fees
Charges may be calculated based on:
Weight (per pound) or dimensional weight, whichever is greater.
Service type (air, sea, or ground).
Additional charges may include but are not limited to:
Processing fees
Service charges
Handling fees
Storage fees
At-home delivery fees
Customs clearance assistance fees
4.2 Payment Terms
Payment is generally required upfront unless otherwise agreed in writing.
Approved business customers may be granted Net 30 payment terms at the Company’s discretion.
Outstanding balances may result in suspension of services.
4.3 Net 30 Payment Terms
Some approved business customers may be allowed to pay their invoices within 30 days of the invoice date instead of paying upfront.
This option is available by approval only and is offered at the discretion of HD Swiftwave Shipping.
4.31 Net 30 Application Policy
Eligibility:
Net 30 payment terms are available to registered businesses only and are subject to approval by HD Swiftwave Shipping.
Application Requirements:
Businesses applying for Net 30 terms may be required to provide:
Valid business registration documents
Government-issued identification for the business owner or authorized representative
Trade references or proof of prior transaction history
Completed Net 30 application form
Approval & Limits:
Approval is not guaranteed and is granted at the Company’s discretion
Credit limits may be assigned and adjusted at any time
Approval may be revoked without notice if terms are breached
Payment Terms:
Invoices must be paid in full within 30 calendar days of the invoice date
Late payments may result in suspension of services or legal recovery action
5. Liability and Insurance
5.1 Liability Limits
HD Swiftwave Shipping’s liability for loss, damage, or delay is strictly limited as follows unless additional insurance is purchased:
Air Freight: Maximum liability of JMD $25,000 per shipment or JMD $500 per pound, whichever is lower.
Sea Freight: Maximum liability of JMD $50,000 per shipment.
Ground Transportation: Maximum liability of JMD $20,000 per shipment.
The Company is not liable for indirect, incidental, or consequential damages including loss of profit or business interruption.
5.2 Claims Process
All claims must be submitted in writing within 7 calendar days of delivery for damaged items, or 14 calendar days for lost items. Claims must include proof of value, photographs (where applicable), and the original invoice.
5.3 Insurance
Optional shipment insurance may be arranged upon request at an additional cost. Uninsured shipments travel at the customer’s own risk beyond the stated liability limits.
6. Prohibited Items
The Company does not accept shipment of prohibited or restricted items, including but not limited to:
Firearms, ammunition, explosives
Illegal drugs and narcotics
Hazardous or dangerous goods
Currency, precious metals, or stones
Counterfeit goods
Perishable items without prior approval
Any items restricted under Jamaican customs, aviation, or maritime laws
The Company may open and inspect shipments where legally permitted.
7. Delivery Terms
7.1 Standard Delivery Timeframes
Estimated delivery times are provided as guidance only and are not guaranteed:
Air Freight: 3–5 business days after arrival in Jamaica and customs clearance
Sea Freight: 14–28 business days after vessel arrival and customs clearance
Ground Transportation (Local): 1–3 business days within Jamaica
Delays may occur due to customs inspections, weather conditions, or other factors beyond the Company’s control.
7.2 Failed Deliveries
If delivery cannot be completed due to incorrect address details, unavailability of the recipient, or refusal of delivery, the shipment may be returned to storage. Additional delivery or storage fees will apply.
7.3 Storage Fees
Shipments uncollected after 7 business days of notification may incur storage charges calculated daily. Shipments left uncollected after 30 days may be deemed abandoned.
8. Force Majeure
The Company shall not be liable for failure or delay in performance due to events beyond its control, including but not limited to:
Acts of God
Severe weather conditions
Customs delays
Government actions or regulations
Industrial action or transport disruptions
9. Dispute Resolution
Customers should first submit complaints in writing to [email protected].
Disputes not resolved amicably shall be governed by and construed in accordance with the laws of Jamaica.
The courts of Jamaica shall have exclusive jurisdiction.
10. Privacy and Data Protection
The Company collects and processes customer information solely for service delivery, billing, and legal compliance. Information is handled in accordance with applicable Jamaican data protection laws and will not be shared with third parties except where required for service provision or by law.
11. Modification of Terms
The Company reserves the right to amend these Terms and Conditions at any time. Updated terms will be published on the Company’s website and take effect immediately upon publication.
12. Termination
The Company may suspend or terminate services or customer accounts for:
Breach of these Terms and Conditions
Non-payment of fees
Illegal or fraudulent activity
Customers may request account closure in writing, subject to settlement of all outstanding balances.
13. Refund Policy
Refund requests must be submitted in writing within seven (7) days of service completion.
Refunds, if approved, will be processed within 14 business days.
Service fees, handling charges, and customs-related costs are generally non-refundable.
By using the services of HD Swiftwave Shipping, customers acknowledge that they have read, understood, and agreed to these Terms and Conditions.
Appendix A: Customs Blocked & Prohibited Items List
HD Swiftwave Shipping does not accept the following items for shipment under any circumstances, in accordance with Jamaican law and international shipping regulations:
Absolutely Prohibited Items:
Firearms, ammunition, explosives, and weapons of any kind
Illegal drugs, narcotics, and controlled substances
Counterfeit goods and pirated materials
Pornographic or obscene material
Human remains or body parts
Hazardous waste
Restricted / Conditional Items (Require Prior Approval):
Alcohol and tobacco products
Lithium batteries and electronic devices containing them
Cosmetics, creams, and liquids
Food items (perishable or non‑perishable)
Medicines, supplements, and vitamins
Customers are responsible for ensuring compliance with Jamaica Customs Agency regulations. Any fines, penalties, or seizure resulting from prohibited or misdeclared items are the sole responsibility of the customer.
